Freight-Dispute Arbitration Fees

Arbitration Options - Single Arbitrator or Arbitration Panel:

Disputing parties have the option of either a Standard (Single Arbitrator) which is the most common option as it is also the most economical.  This is the same as having a single judge on a trial or an Arbitration Panel (Three Arbitrators) which is the suggested option for more complicated disputes and reduces the possibility of error as the majority decision prevails.  We recommend an Arbitration Panel for disputes which involve complex issues and disputes involving in excess of USD 20,000.  However the ultimate choice of a Single Arbitrator or an Arbitration Panel is between the disputing parties.

 

Arbitration Fees:

FreightDisputes charges a flat fee as follows:

 

Standard Arbitration

(Single Arbitrator)

Arbitration Panel

(Three Arbitrators)

USD 250/disputing party

USD 600/disputing party

 

Payment Terms:

Arbitration Fees are payable upon both parties agreeing to tender their dispute to Binding Arbitration.  FreightDisputes will issue an invoice and payment can be accepted by Wire Transfer, US Dollar Check or Credit Card.  Arbitration will not commence until funds have been received.

 

Allocation of Fees:

The disputing parties will initially pay their own fees.  However, the Arbitrator's decision will include the assessment of the Arbitration Fees against the losing party, or to distribute the costs between the parties in whatever proportion they deems equitable.
